County Clerks receive questions concerning electronic transactions and electronic signatures as it relates to Land Records and Title Property.
It is important to understand that the UNIFORM ELECTRONIC TRANSACTIONS ACT specifically EXCLUDES THE FOLLOWING:
- Wills, Codicils or Testamentary Trusts
- Conveyance of any interest in real property
- The creation or transfer of any negotiable instrument or any instrument establishing title or an interest in title.
As it relates to Land Records, the word conveyance includes deed, mortgage, assignment, release, encumbrance, land use restriction, plat etc. All of these documents convey an interest in real property.
